NOTICE IS HEREBY GIVEN THAT PURSUANT TO THE CODE OF THE BOROUGH OF EAST STROUDSBURG, ZONING CHAPTER 157-20. A- THE ZONING HEARING BOARD OF THE BOROUGH OF EAST STROUDSBURG SHALL CONDUCT A HEARING– and decide appeals where it is alleged by the appellant that the Zoning Officer has failed to follow prescribed procedures or has misinterpreted or misapplied any valid provision of this chapter and/or map or any valid rule or regulation governing the action of the Zoning Officer. Nothing contained herein shall be construed to deny the appellant the right to proceed directly in court, where appropriate, pursuant to Pennsylvania Rules of Civil Procedure, Rules 1091 to 1098, relating to mandamus.

APPEAL FROM THE DETERMINATION BY THE ZONING OFFICER THAT THE USE GRANTED BY ZONING PERMIT NO; 55(UNSIGNED), FOR- A “College Fraternity” was no longer valid in as much as Phi Sigma Kappa is no longer a recognized fraternity by East Stroudsburg University and has lost its Charter from the National Organization. A Zoning Enforcement Notice indicating that the property had lost its designation as a College Fraternity and therefore must adhere to Section 157-100.10 Unrelated Persons in a Dwelling Unit- having a maximum of 4 unrelated persons as occupancy was issued on Nov.4, 2019 and was not appealed. Subsequent to that date the, Property Owner applied for a rental license for 4 unrelated persons in compliance with Section 157-100.10

THE RELIEF SOUGHT IS TO CONTINUE THE OCCUPANCY OF 91 ANALOMINK STREET AS A COLLEGE FRATERNITY.
